View Full Version : Payment Upfront? What are my rights?
I have pre paid a host for 1 years reseller package and am starting to regret it...
In the first week of being with them my site has gone offline 3 times. This was fixed and the site came back online within, at most, 30 mins...
However last night the site went down again, for longer (how long i am unsure as I went to sleep) but when I woke up this morning the files on the server had all been rolled back to what they were when I first uploaded them...
Unfinshed versions had been put back in my webspace as if they had restored a backup.
Also a pop address I had created dissapeared, and the Zend Optimizer they had installed on the server to allow me to run WHMAutopilot has gone.
This is terrible service
And to top it all off, nothing has been sent to me to even notify me that they had problems. No mention that they had put older versions of my files back on the server.
I have paid them a dollar amount up front and am thinkin gof cancelling.
What rights do I have to get my money back on the unused months?

I know the username and password are correct to what I set them, and have checked my spelling and caps-lock etc...
This is unbelievable
Do they have a money back guarantee...If so check into it...If not check their tos and see if theres anything about uptime..

Yeah, read the tos. if you don't understand it, pm me the link and i'll have a read for you.
If they have a statement about uptime then they will tell how much you can expect. If they have broken it, ask for your money back. If they haven't then your only entitled to what the terms state.

if they don't give your money back despite having a promise / gauruntee then take a print off from the section of the policy that shows it.
send them an email warning them that you intend to do a chargeback as they have not returned your funds as per their rules. Normally they will then refund.
otherwise head off down your bank and play chargebacks with them :)

I dont want to name the company directly as this, according to them is a one off problem...
I dont believe, nor do i disbelieve this asa such, so therefore I will keep the name underwraps in this post...

Thats one reason why alot of people are discouraged from doing yearly payments as the host may be good this week but there no telling what the other 51 weeks of hosting may bring...
If you paid before 3 months (90 days) ago and with a credit card you can always do a chargeback. If, and only if, they aren't willing to work with you or refund the money you deserve, contact your credit card company. Customers almost always win chargebacks...

Actually - it is 180 days for most Credit cards. And I have seen a few chargebacks go even longer.

I agree, yearly payments are not a wise choice unless you've previously tried the service and have a good standing relationship with the provider. Even then they can be iffy. I ALWAYS recommend monthly payments to clients. Not only is it less risk for them, I personally prefer to have a steady stream of income verses a lump sum.

Why would you have a reseller account if you are running a business? Or are you asking this cause they are a business? As many said, not a wise move to pay for a FULL year cause you don't know if they are going to be around the next day, even better their service will go down hill from the first day. Just request a refund for the time left on your contract if it is in there, if it isn't just tack it up as a loss.
