Situation1:

A .com domain has been owned by a P/L? in Australia since 2001. The .com website is online but has been only a template with just an email address and no other relevant info for probably at least the last 6 months. Since they have no info on their site, I'm not sure what kind of business they do specifically other than hints from the domain name.

After doing a reverse IP lookup, I find the server has 3 websites on it with the other 2 only having 1 line of text each and no email address. Those 2 were purchased earlier this year. It appears all 3 websites are just placeholders.

After doing a search with the US PTO, I find no US trademark by that domain or company name.

Btw, interestingly, the nameservers appear to be dynamic: mydyndns.org. It appears this person is running these sites from home.

Situation2:

A software product or service "x" is available in Canada. A service business is legally registered in the US under "x" and the US Business registers x.com. Service "x" in Canada and Service "x" in US are different services, somewhat but not closely related. i.e. one may be a helpdesk brand and the other may use a helpdesk but not be a helpdesk brand themself.

Question:

Would there be potential US legal issues with registering and using these TLD names?
